Youth Confinement Class Action

The law firms of Koskie Minsky LLP and Sutts, Strosberg LLP are prosecuting a proposed class action against the Province of Ontario concerning the inhumane treatment of young persons under the age of eighteen who were incarcerated in provincial youth custody facilities and subjected to prolonged periods of solitary confinement.

On August 19, 2015, a report by the Provincial Children and Youth Advocate revealed that many youth were being held in solitary confinement for well over 24 hours. This proposed class action alleges that the Province of Ontario breached its fiduciary duty and was negligent in the treatment of these young persons.

On December 22, 2016, Justice Perell granted the Plaintiff’s motion to strike the Third Party Claim, with reasons found here, and granted the Defendant’s pre-certification production motion compelling an application in the Youth Justice Court for release of the Plaintiff’s youth records protected by the Youth Criminal Justice Act, with reasons found here.

On January 5, 2017, the Plaintiff elected to appeal Justice Perell’s decision on the Defendant’s pre-certification production motion. See a copy of the Plaintiff’s Notice of Appeal here.
